この利用規約(以下「本規約」といいます)は、株式会社 ゲインズ(以下「当社」といいます)が運営するウェブサイト「Gyutto」(以下「本サイト」といいます)の利用に関する諸条件を定めるものです。本サイトを利用する方(以下「ユーザー」といいます)は、本規約の以下の条項にしたがって本サイトを利用するものとします。ユーザーが本サイトを利用した場合は、本規約に承諾したものとみなします。
These Terms of Service (hereinafter referred to as "these Terms") stipulate the conditions for the use of the website "Gyutto" (hereinafter referred to as "the Site") operated by Gains Co., Ltd. (hereinafter referred to as "the Company"). Users of the Site (hereinafter referred to as "Users") shall use the Site in accordance with the following provisions. By using the Site, Users are deemed to have accepted these Terms.
本規約における用語の意義は、以下のとおりとします。

Article 1 Definitions
The meanings of the terms used in these Terms are as follows:
Service: The content delivery service and information provision service provided by the Company on the Site.
Work/Content: Digital works such as games, videos, music, and e-books provided on the Site.
Play: Trying, viewing, or browsing the works provided on the Site.
Provider: Doujin circles or business operators that provide works and other information on the Site and hold the copyright, trademark rights, or other rights to them.
ユーザーが本サイトへアクセスするときおよび本サイトを利用するとき、また本サイト指定のソフトウェアを利用するときは、本規約および全ての関連する法律に従う事になります。
Article 2 Scope of Application
When accessing or using the Site, or using software designated by the Site, Users shall comply with these Terms and all applicable laws.
本サイトにおいて、ユーザーが作品をダウンロードによって購入もしくは試用・試聴し、またはメールマガジン等の一部の情報提供サービスを受けるにあたっては、利用の都度ユーザー任意の電子メールアドレスを使用する方法もしくは、あらかじめ必要事項を登録すること(以下「ユーザー登録」といい、「ユーザー登録」をしたユーザーを「登録ユーザー」といいます)により設定したIDおよびパスワード(以下「ID等」といいます)を使用する方法があります。
またマイページより退会の手続きを行うことによって、ユーザー登録を即時解除することができます。退会にあたって手数料等は一切発生いたしません。同様にマイページよりメールマガジンの購読の即時解除を行えます。
Article 3 User Registration
On this Site, to purchase or try/view works by downloading, or to receive certain information services such as email newsletters, Users may use an email address of their choice each time, or use an ID and password (hereinafter “ID etc.”) set after registering the required information in advance (hereinafter referred to as “User Registration”. Users who have completed this are called “Registered Users”).
Users can immediately cancel their User Registration by performing the withdrawal procedure on My Page. No fees are charged for withdrawal. Users can also immediately unsubscribe from the email newsletter via My Page.
ユーザーは、本契約に基づき購入したコンテンツ作品を、当該ユーザー本人に限り、使用することができます。
Article 4 Scope of Use by Users
Users may use content works purchased under this agreement only for their own personal use.
(1)登録ユーザーは、ID等を自己の責任において厳重に管理し、第三者への譲渡、貸与等を行わないものとします。
(2)登録ユーザーのID等の管理不十分、使用上の過誤、第三者の使用等による損害の責任は登録ユーザー自身が負うものとし、運営者は一切の責任を負うものではありません。
(3)登録ユーザーは、IDおよびパスワードの盗難や失念があった場合、またはID等が第三者に使用されていることが判明した場合には、直ちに当社にその旨連絡するとともに、当社からの指示に従うものとします。
(4)登録ユーザーは、登録事項に変更のあった場合は、速やかに当社規定の手続きに従い、届け出るものとします。
(5)登録ユーザーは、当社所定の手続により、いつでもユーザー登録を抹消することができるものとします。
Article 5 Responsibility for Managing ID and Password
(1) Registered Users shall strictly manage their ID etc. under their own responsibility and shall not transfer or lend them to any third party.
(2) Registered Users shall bear all responsibility for damages caused by insufficient management, misuse, or use by third parties of their ID etc. The operator assumes no liability whatsoever.
(3) If a Registered User discovers theft, loss, or unauthorized use of their ID or password, they shall immediately notify the Company and follow its instructions.
(4) Registered Users shall promptly notify the Company of any changes to their registered information in accordance with prescribed procedures.
(5) Registered Users may cancel their User Registration at any time by following the Company’s designated procedures.
本サイトの作品、画面、ドキュメントその他の提供情報に関する著作権、商標権等の知的財産権その他一切の権利は、当社または提供者に帰属します。本サービスの提供によりこれらの権利がユーザーに移転するものではなく、またユーザーは本規約により明示的に許諾された権利以外のいかなる権利を取得するものではありません。
Article 6 Ownership of Rights
All intellectual property rights, including copyrights and trademarks, and all other rights relating to the works, screens, documents, and other information provided on the Site belong to the Company or the Providers. The provision of the Service does not transfer any of these rights to Users. Users do not acquire any rights other than those explicitly granted under these Terms.
ユーザーは、本サイトおよび本サービスを利用するにあたり、次の行為をしてはならないものとします。
Article 7 Prohibited Conduct
Users shall not engage in the following acts when using the Site or the Service:
当社は、登録ユーザーが第7条の禁止行為を行なった場合には、何らの通知催告なくユーザー登録を抹消することができるものとします。
Article 8 Forced Withdrawal
If a Registered User commits any prohibited act in Article 7, the Company may delete the User Registration without any prior notice or warning.
登録ユーザーは、登録ユーザーとしての地位または権利もしくは義務の全部または一部を、第三者に譲渡し、賃貸し、引き受けさせ、または質権その他の担保に供する等の行為を行うことはできません。
Article 9 Prohibition of Transfer
Registered Users may not transfer, lease, assign, or provide as collateral all or part of their status, rights, or obligations as a Registered User to any third party.
Article 10 Disclaimer
1. Even if the Company is legally liable for defects in purchased works, liability is limited to ordinary and direct damages actually incurred by the User, and shall not exceed the purchase price of the work.
2. The Company assumes no liability for defects in free works, even if damage occurs.
3. The Company does not guarantee the accuracy or suitability of information provided on the Site. Users use such information at their own risk.
4. Once a work is discontinued from sale, viewing, downloading, and browsing become unavailable.
当社は以下のいずれかに該当する事由が発生した場合、利用者に通告することなく、本サービスの提供を一時的に停止することができます。
当社は、本サービスの停止・廃止に関し利用者ユーザーに対して一切の責任を負いません。
Article 11 Suspension or Discontinuation of the Service
1. The Company may temporarily suspend the Service without notice if any of the following occurs: maintenance, force majeure, security reasons, or when continuation is deemed difficult.
2. The Company assumes no liability for any suspension or discontinuation of the Service.
ユーザーは、本規約の定めに従って本サービスを利用するものとし、ユーザーは、本規約に同意をしない限り本サービスを利用できません。
本サービスの利用を開始した場合、ユーザーは本規約に同意したものとします。
ユーザーが未成年者である場合は、親権者等の法定代理人の同意を得たうえで本サービスを利用するものとします。
また、ユーザーが本サービスを事業者のために利用する場合は、当該事業者も本規約に同意したうえで本サービスを利用するものとします。
未成年者が本サービスの利用の申込みを行なった場合、当該未成年者は法定代理人の同意を得ているするものとします。
Article 12 Agreement to the Terms
Users shall use the Service in accordance with these Terms and may not use it without agreeing to them. By starting to use the Service, Users are deemed to have agreed. Minors must obtain parental/legal guardian consent. Business operators using the Service on behalf of their business must also agree to these Terms.
また、当社は当社が必要と判断した場合にこの規約を変更ができるものとします。
その場合、当社は、変更後の本規約の内容および効力発生日を、運営サイト上での掲示又はその他の適切な方法によりに表示を行うものとします。
若しくは当社が定める方法によりユーザーに通知することで周知します。
法令上サークルの同意が必要となるような内容の変更の場合は、運営者所定の方法でユーザーの同意を得るものとします。
本規約の変更後に本サイトを利用した場合、ユーザーは変更後の本規約に同意したものとみなします。
Article 13 Amendment of the Terms
The Company may amend these Terms when necessary. The Company will notify Users by posting the revised Terms and effective date on the Site or by other appropriate means. If consent is required by law, it will be obtained by the prescribed method. Continued use after amendment constitutes agreement to the revised Terms.
当社は、本サイトに当社または第三者の広告を掲載することができるものとします。
Article 14 Display of Advertisements
The Company may display advertisements of the Company or third parties on the Site.
当社は、利用者に対し、サービスに関するお知らせ、キャンペーン情報、メールマガジン等を配信する場合があります。
利用者は、当社が指定するメルマガ停止窓口より、いつでもメールマガジンの配信停止を行うことができます。

配信停止後も、サービス運営上必要な通知については送信される場合があります。
Article 15 Email Notifications and Newsletters
The Company may send users service-related notices, campaign information, newsletters, and other promotional communications.
Users may unsubscribe from newsletters at any time using the method specified by the Company.
Even after unsubscribing, users may still receive important operational or administrative notices regarding the Service.
本規約の履行および解釈は日本国法を準拠法とします。
当社とユーザーの間で本規約または本サイトおよび本サービスに関連して紛争が生じた場合は、東京地方裁判所を第一審の専属管轄裁判所とすることに合意するものとします。
Article 16 Governing Law and Exclusive Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of Japan. Any disputes arising between the Company and Users in relation to these Terms, the Site, or the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
To comply with applicable regulatory requirements for different customer groups, these Terms may be subject to different governing laws. UK-based customers are governed by the laws of the United Kingdom, while customers in the APAC region are governed by the laws of Japan.
